聘请外籍教师合同

一、------------------- 聘请------------籍---------------------(外文姓名)-----------(译名)女士(先生)为英语教师。双方本着友好合作精神,自愿签订本合同并保证认真履行合同中约定的各项义务。
二、合同期自 年 月 日起至 年 月 日止
三、受聘方的月薪为人民币 元。
四、聘方的义务:
1.向受聘方介绍中国有关法律、法规和聘方有关工作制度以及外国专家的管理规定。
2.对受聘方的工作进行指导,检查和评估。
3.向受聘方提供必要的工作和生活条件。
4.配备合作共事人员。
5.支付受聘方的报酬。
五,受聘方的义务:
1.遵守中国的法律,法规,不干预中国的内部事务。
2.遵守聘方的工作制度和有关外国专家的管理规定,接受聘方的工作安排,业务指导,检查和评估,未经聘方同意,不得兼任与聘方无关的其他劳务。
3.按期完成工作任务,保证工作质量。
4.尊重中国的宗教政策。不从事与教师身份不符的活动。
5.尊重中国人民的道德规范和风俗习惯。
六,合同的变更,解除和终止:
1.双方应信守合同,未经双方一致同意,任何一方不得擅自更改、解除和终止合同。
2.经当事人双方协商同意后,可以变更,解除和终止合同。在未达成一致意见前,仍应当严格履行合同。
3,聘方在下述条件下,有权以书面形式通知受聘方解除合同:
(1)受聘方不履行合同或者履行合同义务不符合约定条件,经聘方指出后,仍不改正的;
(2)根据医生诊断,受聘方在病假连续30天后不能恢复正常工作的;
4.受聘方在下述情况下,有权以书面形式通知聘方解除合同;
(1)聘方未按合同约定提供受聘方必要的工作和生活条件;
(2)聘方未按时支付受聘方报酬。
七、违约金:
当事人一方不履行合同或者合同义务不符合约定条件,即违反合同时,应当向另一方支付500—2000美元(或相当数额人民币)的违约金。
受聘方因不可抗力事件要求解除合同,需出具有关机构证明,经聘方同意后,离华的费用自理;受聘方若无故解除合同,除离华费用自理外,还应当向聘方支付违约金。
聘方因不可抗力事件要求解除合同,经受聘方同意后,离华费用由聘方负担;聘方若无故解除合,除负担受聘方离华费用外,还应当向受聘方支付违约金。
八、本合同附件为合同不可分割的一部分,与合同具有同等效力。
九、本合同自双方签订之日起生效,合同期满即自行失效。当事人一方要求签订新合同,必须在合同期满90天前向另一方提出,经双方协商同意后签订新合同。
受聘方合同期满后,在华逗留期间的一切费用自理。
十、仲裁
当事人双方发生合同纠纷时,尽可能通过协商或者调解解决。若协商,调解无效,可向国家外国家局设立的外国文教专家事务仲裁机构申请仲裁。

-----中学(以下简称甲方)聘请----(以下简称乙方)为外籍教师。双方本着友好合作的精神签订本合同附件,并保证认真履行附件中的各项义务。
甲、乙双方应共同遵守国家外国专家局制定的《外国文教专家生活待遇条件》中的有关条款。
1.乙方在甲方工作的总学时数为--课时/周。主要担任课程有
(1)英语口语教学
(2)开展英语课外活动、讲座
(3)培训本校英语教师口语
乙方参加甲方的英语教研及相关学术活动,对学生进行课外英语辅导等不计在学时效内。
2.甲方应根据不同班级的教学要求制定相应的教学内容,安排课程表。乙方应将教学计划和教材内容事先交甲方审定,并按指定的时间和地点上课。在教学过程中,经甲方同意,乙方可适当调整教学计划或内容。乙方根据教学需要补充的教材、资料等,应经甲方同意,方可使用。当甲方对乙方进行教学评估时,乙方应予以合作。
3.甲方按月(每月10日)支付乙方工资,时间从2002年3月3日至2002年6月30日止。
4.甲方须支付乙方(外教)在到职期间所发生的国内段机票款,连同50元机场建设费和20元保险费。
5.对任职半年的外教,甲方应提供旅游津贴1100元。
6.甲方应负责支付乙方到职后办理各种手续,包括住宿证、居留证和专家证及有关费用。
7.乙方受聘期间,甲方为其免费提供的住房及其设施(如:电视(上网费用自理)、冰箱,洗衣机,热水器、电话(电话费自理)等)仅供乙方专用。乙方(外教)将每月按时支付电话费和上网费。
8,乙方来客探访需投宿者,乙方应提前三天告知甲方,并由甲方妥善安排住宿,费用自理。
9.乙方受聘期间,免费享受甲方(校内)的医务室治疗。如需到校外医院治疗,甲方半年应为乙方提供医疗费用人民币500元,超出部分自理。
10.休假遵循国家外专局有关规定。
本合同附件于2002年3月,在江苏省常州市田家炳实验中学三楼会议室(地点)签定,中文和英文文本一式两份,甲,乙/双方各保留一份。两种文本具有同等法律效力。
CONTRACT
I. Party A ――――――――――――wished to engage the service of Party B ―――――― as a foreign teacher. The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfil conscientiously all the obligations stipulated in it.
II. The period of service will be from the -------day of ------,20------to the ------day of-----, 20-----.

IV. Party B's monthly salary will be ¥2300yuan RMB.
V. Party A's Obligations
1. Party A shall introduce to Party B the laws, decrees and relevant regulations by the Chinese government, the Party A's work system and regulations concerning administration of foreign experts.
2. Party A shall conduct direction, supervision and evolution of Party B's work.
3. Party A shall provide Party B necessary working and living conditions.
4. Party A shall provide co-workers.
5. Party A shall pay Party B's salary regularly by the month.
VI. Party B's Obligations
1. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China' s internal affairs.
2. Party B shall observe Party A's work system and regulations concerning administration of foreign experts and shall accept Party A's arrangement direction, supervision and evolution in regard to his/her work. Without Party A's consent Party B shall not render service elsewhere or hold concurrently and post unrelated to the work agreed on with Party A.
3. Party B shall complete the tasks agreed on schedule and guarantee the quality of work.
4. Party B shall respect China's religious policy, and shall not conduct, religious activities incompatible with tile status of a teacher.
5. Party B shall respect the Chinese people's moral standards and customs.
VII. Revision, Cancellation and Termination of Contract
1. Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.
3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
(1) Party B does not fulfil the contract or does not fulfil the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.
(2) According to the doctor's diagnosis. Party B cannot resume normal work after a continued 30 day sick here.
4. Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
(1) Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
(2) Party A has not paid Party B as scheduled.
VIII. Breach Penalty
When either of the two parties fails to fulfil the contract of fails to fulfil the contract obligations according to the terms stipulated, that is, break the contract, it must pay a breach penalty of US $500 to 2000(or the equivelant in RMB).
If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A's consent and pay its own return expenses; If Party B cancel the contract without valid reason, it should pay its own return expenses and Pay a breach penalty to Party A.
If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses; if Party A cancel the contract without valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.
IX. The appendix of this contract, is an inseparable part of the contract and has equal effect.
X. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent.
Party B shall bear all expenses incurred when staying on after the contract expires.
XI. Arbitration
The two parties shall consult with each other and mediate any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Bureau of Foreign Experts and ask for a final arbitration.

APPENDIX TO THE CONTRACT
Jiangsu Changzhou Tianjiabin Experimental Middle School (Party A) wishes to engage the service to Ms. Alice Thomson (Party B) as its foreign teacher. Both parties, in file spirit of friendly cooperation, agree to sign this Appendix, which is a continuous part of the contract, and pledge to fulfill conscientiously all the obligations stipulated in it.
Both parties shall abide by the terms concerned in the papers "The living Conditions of Foreign Experts Working in Cultural and Educational Institutes". issued by the State Bureau of Foreign Experts of China.
Party. B shall work for Party A 14 teaching hours per week totally. The courses that Party B should conduct are as follows:
1) To teach Spoken English in Senior Middle School.
2) To organize the outside class activities and lectures.
Party B is advised to take part in teaching or other related academic activities, and coach his students, if required, after class. That shall not be included in the regular teaching hours.
II. Party A shall work out the outlines of the different classes and set up the schedules of the classes. Party B shall make out the syllabi for each course and present them to Party. A for approval. Party B shall give lessons in the suggested classroom at the given time. When deemed advantageous, Party B may, with the consent of Party. A, adjust his or her syllabi, use self-prepared materials, videocassettes or other materials. When Party A evaluates Party B's work, Party B is advised to offer cooperation.
III. Party A shall pay Party. B monthly (10th of the month), commencing from March 3th 2002 to June 30th 2002.
IV. Party A shall pay Party B the expense of flight from Beijing to Nanjing and 50 yuan ,which is the expense of airport construction and 20 3man, insurance.
V. Party A shall pay Party B 1100 yuan as a travel allowance if Party B teaches for half a year.
VI. Party A shall pay all the expenses of going through all the formalities, such as residence paper, foreign expert certificate.
VII. When Party. B performs the obligations stipulated in the contract, the lodgings and other facilities provided by Party A are for Party B's private use during his/her service in TJBEMS, such as a TV set, telephone, e-mails, refrigerator, washing machine, and water-heater etc. Party B shall pay for the use of domestic and international telephone calls, fixes and e-mails for his/her private purpose. Party B shall pay the expenses of domestic and international telephone calls, fixes and e-mails etc. in time every month.
